The WTO TRIPS Agreement (Agreement on Trade Related Aspects of Intellectual Property Rights) calls its members to protect plant varieties by a patent or an effective sui generis system (Article 27, paragraph 3, sub b TRIPS Agreement). Plant varieties The WTO considers the UPOV system for protection of Plant Breeders' Rights as such an effective sui generis system.
Partly because of this obligation of the TRIPS Agreement, the number of States which becomes member of the UPOV Convention is still growing.
