UPOV Convention 1991
The UPOV Convention 1991 provides the legal basis to member States to encourage breeders to develop new plant varieties by providing an intellectual property right: the Plant Breeders' Right.. Membership of the UPOV Convention obliges participating countries to implement a national Plant Breeders' Rights system in accordance with the UPOV Convention. This national Plant Bbreeders' Right system has to be approved of by the UPOV Councul and only then the UPOV membership is accepted.
The Netherlands has also joined the UPOV convention and thus has a system of Plant Variety protection which is based on the UPOV Convention. This legal system is laid down in the Nehterlands Seeds and Plant Material Act 2005.
