To all maintainers in the UK with varieties in the Dutch Variety Register NRR
The United Kingdom (UK) has finally left the European Union (EU) on 31 December 2020. In 2020, a transition right was in force, until 31 December 2020. In this period all EU-regulations and laws were still in force for the UK. This transition period has been terminated now. This has major consequences, also for maintainers in the UK with varieties included in the Dutch Variety Register NRR.
All varieties of vegetables, fruits, agricultural crops, and propagating material of forest crops that are included in the Dutch Variety Register NRR, but are maintained in the third country UK, were removed by the EU from the Common Catalogue. By this reason, these varieties cannot be traded in the EU at the moment.
The law prescribes that maintenance must take place in an EU-member state, ór in a so-called ´Equivalent Country´. It is still not clear if the UK will be accepted as an ´Equivalent Country´. This depends on the results of the on-going negotiations. We expect that the declaration of equivalence of the UK may take weeks or months.
Therefore, our message to you is: if you want to continue trading your varieties in the EU: these varieties have to be maintained in a remaining Member State of the EU (wether or not through an agreement with a (local) representative/agent). If this representative is formally adopted, these varieties can be re-introduced in the Common Catalogue of the EU (for propagating material of forest crops in Forematis).
It is the responsibility of the companies to organize the maintenance in the right way. This means that the companies themselves must take care for the maintenance in an EU-member state or in an ´Equivalent Country´.
